Introduction
These Terms and Conditions (“Terms”) apply to your access and use of all Dibil online products or services (collectively the “Services”) provided by Dibil Corp. (“Dibil”, “we”, “us”, “our”). Definitions in these terms apply to both our Privacy Policy (“Privacy”), Community Agreement (“Community”), and overall “User Agreement”. Currently, Dibil is only intended for use in the United States. By accessing or using Dibil, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.
Access
No one under the age of 13 is allowed to use the Services. By using the Services, you state that:
You are at least 13 years old and over the minimum age required by the laws of your country of residence to access and use the Services;
You can form a binding contract with Dibil, or, if you are at least 13 but under the age of majority in your jurisdiction, that your legal guardian has reviewed and agrees to these Terms;
You are not barred from using the Services under all applicable laws; and
You have not been permanently suspended or removed from the Services.
If you are accepting these Terms on behalf of another legal entity, including a business or government entity, you represent that you have full legal authority to bind such entity to these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

Community
Dibil’s Community Agreement can be accessed at any time on our website: www.dibil.co/.
Use of Services
Subject to your complete and ongoing compliance with these Terms, Dibil grants you a personal, non-transferable, non-exclusive, revocable, limited license to:
(a) install and use a copy of our mobile application associated with the Services that is obtained from a legitimate marketplace on a mobile device owned or controlled by you; and
(b) access and use the Services.
We reserve all rights not expressly granted to you by these Terms.
Except and solely to the extent such a restriction is impermissible under applicable law, you may not, without our written agreement:
License, sell, transfer, assign, distribute, host, or otherwise commercially exploit the Services;
Modify, prepare derivative works of, disassemble, decompile, or reverse engineer any part of the Services.
You acknowledge that while we strive to make our Services accessible to users with disabilities, certain image-based features may have limited accessibility options.
We may maintain archived copies of your Content for backup, legal compliance, or historical documentation purposes, even after you delete specific posts or your account.
Content
Content refers to photos, captions, comments, or profile photos shared through our Services. You are responsible for the Content you share through our Services, including ensuring that you have the right to use the Content, and that it complies with laws, rules, regulations, and our Terms. By posting Content on our Services, you represent and warrant that you own or have obtained all necessary rights, licenses, consents, and permissions to use and authorize Dibil to use the Content. This includes any music, audio, or third-party elements that may be included in your images or posts. When sharing images that include identifiable individuals, you represent that you have obtained necessary permissions from those individuals for sharing their likeness on our Services. Dibil is not responsible for any content shared externally by other users. If you share Content that you do not have the right to use or that violates laws, rules, regulations, or the User Agreement, we have the right to remove it.
Private Content: Content shared using a private profile means you are sharing only with your approved followers on Dibil. On a voluntary basis, some people may choose to share this content with Dibil so that it can be used for communication, commercial, and marketing purposes. For instance, on billboards, other advertising, Apple’s App Store, or Google’s Play Store. If you decide to do that, you will need to grant Dibil permission to use this Content.
Public Content: Content shared using a non-private profile means it will be shared with everyone on Dibil. This Public Content is not restricted the same way Content is when shared with a private profile. In exchange for using our Services, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute the Public Content you share in any and all media or distribution methods. This license authorizes us to make Public Content available to the rest of the world and to let others do the same. You agree that this license includes the right for Dibil to provide, promote, and improve our Services and to make Public Content available to other companies, organizations, or individuals for syndication, broadcast, distribution, promotion, or publication on other media and services. Such additional uses by Dibil, or other companies, organizations, or individuals, are made with no compensation paid to you with respect to the Public Content as the use of our Services by you is hereby agreed as being sufficient compensation.
Reporting
We are not under an obligation to monitor the Content people share through our Services. Nevertheless, we want our Services to be a place where people can have fun and express their real selves while feeling safe. Content that violates another person’s rights, or does not comply with laws, rules, regulations, or the Terms (“Violative Content”), is prohibited. If you see Violative Content, you can report it to us through the reporting feature. While we strive to review reported content promptly, we do not guarantee specific response times. Depending on the nature of the report, some content may be automatically removed pending review.
If you believe your Content has been copied in a way that infringes your intellectual property rights, you can report this directly in the application.

We respect copyright law. If you believe someone has copied your work without permission, you can submit a copyright complaint to support@dibil.co with:
A description of your copyrighted work
Where on Dibil you found the infringing content
Your contact information
A statement that you believe the use is unauthorized
A statement that your complaint is truthful
Changes
We are always improving our Services. This means we may add or remove features or functionalities; we will try to notify you beforehand, but that won’t always be possible. We reserve the right to modify, suspend, or discontinue the Services (in whole or in part) at any time, with or without notice to you. Any future release, update, or other addition to the functionality of the Services will be subject to these Terms, which may be updated from time to time. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Services or any part thereof.
Termination
We reserve the right to terminate or suspend your access to our Services, without prior notice or liability, for any reason, including if you breach these Terms.
Indemnity
You agree to indemnify, defend, and hold harmless Dibil and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or related to your use of the Services or breach of these Terms.
Disclaimer and Limitation of Liability
Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, Dibil disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall Dibil be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services. Our Services are not intended for emergency communications. Dibil is not liable for any claims arising from attempts to use our Services for emergency purposes or time-sensitive matters. Our Services may contain links to third-party websites or services not owned or controlled by Dibil. We have no control over and assume no responsibility for any third-party content, websites, services, or practices. Dibil shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of war, terrorism, natural disasters, power failures, or government actions.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of The United States of America, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal or state courts located in The United States of America. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in class action lawsuits against Dibil. If any provision of these Terms is found to be unenforceable, that provision shall be severed and the remainder shall remain in full force and effect.
